Our directors, Nichol Yeo, Clement Tan and Qua Bi Qi published a guide on Complex Commercial Litigation in Singapore on Lexology.
March 2025: Successful Application for Worldwide Mareva Injunction
Successful applied for and obtained a worldwide Mareva injunction against a defendant in respect of purported gifts obtained. The injunction prohibited the defendant from disposing or dealing with assets up to S$ 10.2 million.
January 2025: Contested Worldwide Mareva Injunction in Excess of S$ 100 million
Instructed as counsel for a worldwide Mareva injunction arising out of matrimonial proceedings. The assets involved exceeded the sum of S$ 100 million.
March 2025: Successful resistance of application in third party proceedings
Successfully resisted an application to dismiss, terminate and/or set aside third party proceedings within ongoing commercial litigation. The matter required detailed procedural strategy and careful navigation of multi-party liability issues.
March 2025: Successful Appeal Against Striking Out Order
Successfully defended a striking out order on appeal. The claim that was struck out involved an ex-director of an SGX listed company claiming for fraudulent misrepresentation.
April 2025: Successfully defended an application for unless order
Successfully resisted, both at first instance and on appeal, an application for unless order premised on alleged non-compliance with a production order.
May 2025: Successfully obtained a Worldwide Mareva Injunction for S$ 1.7 million
Successfully obtained a worldwide Mareva injunction for S$ 1.7 million in a claim by the executrix of an estate. The claim involves allegations of breach of fiduciary duties, resulting trust, undue influence and unconscionability.
May 2025: Appeal Against a Murder Conviction on the Partial Defence of Sudden Fight
Represented an accused person convicted of murder under Section 300(c) of the Penal Code on appeal. Involved in the arguments on the defence of sudden fight.
June 2025: Defending a claim for an account of monies allegedly held on resulting trust and common intention constructive trust
Represented the executrix of an estate sued in her personal capacity in defending a claim for an account of rental monies from a coffeeshop. Involved arguments on resulting trust and common intention constructive trust.
August 2025: Injunction Against EGM of an SME
Argued and obtained an urgent injunction that was obtained at short notice (within 24 hours) to restraining the holding of an EGM of a SME. This maintained the Board control of the SME. Successfully defended an application to strike out the originating application, both at first instance and on appeal.
August 2025: Striking Out of Without Prejudice Material
Successfully applied to strike out without prejudice material from affidavit evidence in a highly contested matrimonial dispute. Also successfully obtained an order to compel to production of documents and answers to interrogatories.
November 2025: Successfully struck out a claim by multiple claimants, including foreign claimants, for a share in a private residential property
Successfully struck out a claim for a share in a private residential property, or a share in the sale proceeds of the property, in its entirety. Involved complex arguments involving sections 3 and 23 of the Residential Property Act 1976, the use of the Vandepitte procedure, and trust over choses in action.
January 2026: Successful claim on unusual guarantee clause
Successfully claim in enforcement of an unusual guarantee clause. The matter turned on novel issues of contractual construction and the commercial intent underpinning the security arrangement.
January 2026: Succeeded at a District Court trial in a claim where the terms of a settlement agreement were disputed
Successfully claimed for damages against the guarantor for a settlement agreement. The guarantee imposed a unique obligation – instead of the usual wording where the guarantor had to pay on the debtor’s behalf, the guarantor had to find a third party to pay on the debtor’s behalf.
January 2026: Claim of Right Against Self-Incrimination to Resist Pre-Action Discovery
Successfully invoked the privilege of self-incrimination against a court application for pre-action discovery in a high-profile cryptocurrency case.
